Councils have the responsibility for amongst other things, determining most development applications, preparation of Local Environmental Plans (zoning plans) and also Development Controls Plans. Development Control Plans contain information that determines the detail development rules about how land can be developed such as height, floorspace ratio, building setbacks, landscaped area and merit mattes such as privacy and overlooking and overshadowing.
The structure is an intricate one and while New South Wales is currently considering Planning Reform legislation to simplify aspects of the planning system, complexities will always remain where the necessity arises to engage qualified and experienced professionals to guide you through the development application process.
